LANDRY: THE U.S. SUPREME COURT NEEDS TO TAKE UP ELECTION CASES

IMG_1589.jpeg

Louisiana Attorney General Jeff Landry issued the following today regarding the 2020 elections:

Millions of Louisiana citizens, and tens of millions of our fellow citizens in the country, have deep concerns regarding the conduct of the 2020 federal elections. Deeply rooted in these concerns is the fact that some states appear to have conducted their elections with a disregard to the U.S. Constitution.

Furthermore, many Louisianans have become more frustrated as some in media and the political class try to sidestep legitimate issues for the sake of expediency.

Weeks ago, on behalf of the citizens of Louisiana, my office joined many other states in filing a legal brief with the United States Supreme Court urging the Justices to look into the conduct of the election in Pennsylvania where their state court ignored the U.S. Constitution in regard to the conduct of the election.

The U.S. Constitution in Article 1, Section 4, states plainly: “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature …” The power for the conduct of federal elections is held by the State Legislatures in each state. In states like Pennsylvania, the judicial branch attempted to seize control of these duties and obligations and to set their own rules. These actions appear to be unconstitutional.

If it is unconstitutional for Pennsylvania to take this action, it is similarly unconstitutional for other states to have done the same.

Only the U.S. Supreme Court can ultimately decide cases of real controversy among the states under our Constitution.

That is why the Justices should hear and decide the case which we have joined representing the citizens of Louisiana.

Furthermore, the U.S. Supreme Court should consider the most recent Texas motion, which contains some of the same arguments.

Louisiana citizens are damaged if elections in other states were conducted outside the confines of the Constitution while we obeyed the rules.

OFFICIAL: The LAGOP is extremely disappointed in Judge Morvant's ruling

FOR IMMEDIATE RELEASE
November 13th, 2020

(Baton Rouge, LA) – The Republican Party of Louisiana is very disappointed in Judge Morvant's ruling on the Louisiana House's petition to put an end to Governor Edward's government overreach. Time and time again Governor Edwards has taken advantage of his power and used it to control the people of Louisiana. This arbitrary control should have been put to an end TODAY!

Judge Morvant stated that "there's a lot unusual in this case, there is a lot unusual in 2020." We agree! Keeping business closed, children out of school, and people unemployed is indeed unusual. There is no valid reason to continue to allow the Governor to control our lives.

In America, we are a government of, by, and for the PEOPLE. It is time for the Governor to end his reign and give freedom back to the people of Louisiana!

Consequences of a Biden Admin for US Energy

A change of federal government would have several consequences for the U.S. energy industry, according to energy research and consultancy company Wood Mackenzie.

Some of the most important of these, according to Ed Crooks, Wood Mackenzie’s Americas vice chair, would be restrictions on oil and gas development and new hurdles for oil and gas infrastructure projects.

LOUISIANA CITIZENS FOR JOB CREATORS: AG Landry Leads Fight Against Election Fraud

This week AG Jeff Landry led the Republican Attorneys General Association (RAGA) in filing an amicus brief with the United States Supreme Court in support of the Pennsylvania GOP challenge of an earlier Pennsylvania high court ruling that allowed the state to count absentee ballots up to three days after Election Day, so long as they were postmarked by November 3, 2020.

Over the last week our country has been rocked by antidotes of voter fraud running rampant throughout the country, but especially in key battle ground states like Pennsylvania. Now, the Attorneys General are imploring the Supreme Court to determine whether the Pennsylvania grace period for mail in ballots is constitutional and those votes legitimate.

“Once all legitimate votes are counted and irregularities are corrected, then irrespective of who the president is, we will continue to ensure that rule of law is protected,” AG Landry said in the RAGA press conference held yesterday.

The integrity of free and fair elections in the United States is at stake! Thank you AG Landry for continuing to stand up for the rule of law and ensuring that liberal, left-wing activists have to play by the same rules as everyone else when it comes to elections!

LOUISIANA CITIZENS FOR JOB CREATORS: AG Landry Strikes at Google Monopoly!

IMG_0748.png

This week AG Landry announced that Google has entered into a series of exclusionary agreements to lock up the primary avenues through which users access search engines and the internet, by requiring that Google be set as the default or exclusive search engine on billions of mobile devices and computers.

"Google has grown into a big tech monopoly that has stifled competition. Without competition, we do not have capitalism; and without capitalism, we do not have America. So I am proud to join Attorney General Bill Barr in this fight for America,” - AG Jeff Landry

The lawsuit specifically alleges that Google has unlawfully maintained monopolies in search and search advertising by:

  • Entering into exclusivity agreements that forbid preinstallation of any competing search service.

  • Entering into tying and other arrangements that force preinstallation of its search applications in prime locations on mobile devices and make them undeletable, regardless of consumer preference.

  • Entering into long-term agreements with Apple that require Google to be the default – and de facto exclusive – general search engine on Apple’s popular Safari browser and other Apple search tools.

  • Generally using monopoly profits to buy preferential treatment for its search engine on devices, web browsers, and other search access points, creating a continuous and self-reinforcing cycle of monopolization.

Landry said these, and other anticompetitive practices, harm competition and consumers, reducing the ability of innovative new companies to develop, compete, and discipline Google’s behavior.

We’re glad that AG Landry is fighting against the monopolies of Big Tech! They have been stifling competition and controlling internet searches for too long! We need to keep these tech companies in check! As technology becomes more and more important to our everyday lives, companies like Google need to be held accountable for their actions!

Thanks to AG Landry for fighting back against Google and their monopolistic actions!

MIGUEZ: House Republicans Sign Petition to End Governor’s COVID Emergency Overreach

IMG_0747.jpeg

Baton Rouge, LA — Today, Republicans in the Louisiana House combined previous efforts and joined together to sign one petition, stopping the Governor’s unprecedented expansion of executive power under his never-ending COVID-19 Emergency Declaration.

This petition from the House of Representatives has the endorsement and support of the House Republican Delegation.

House Republican Delegation Chairman Blake Miguez issued the following statements:

“When any emergency process lasts this long, the public deserves transparency. The Governor should be providing more information and data, not more mandates and restrictions. We trust Louisianans to keep their families, neighbors, and customers safe.”

"For months, Republicans in the House worked tirelessly, exploring every available option to reopen Louisiana safely. We have repeatedly asked Governor Edwards to share additional information with our constituents and explain his endless restrictions on their families, churches, and businesses. Unfortunately, it's become clear the Governor will not surrender his temporary emergency powers. His refusal to give the people of Louisiana (through their elected representatives) a voice in the discussion of how to move our state forward is unacceptable."

OPINION: A ‘buy American’ rule is counterproductive to fight coronavirus

Trade protectionism is about to be deployed in the fight against the coronavirus. It won’t work, but it will do a lot of harm.

This week, President Trump is expected to sign an executive order that would severely disrupt global medical supply chains, and could delay the availability of a coronavirus vaccine.

LOGA: Support of Constitutional Amendment 2

Constitutional Amendment 2 would bring fairness, predictability to oil and gas well assessment process

BATON ROUGE, LA (October 5, 2020) — A ‘yes' on Constitutional Amendment 2 would bring fairness and accuracy to the assessment process for Louisiana’s oil and gas wells, assessor and industry representatives agree.

Although there are three ways to assess property, (those methods are the ‘cost,’ ‘market’ and ‘income’ methods) the state constitution only includes the use of two for oil and gas wells in Louisiana. CA-2 would include the income approach as the third methodology to value oil and gas wells for property assessment. The income approach values wells based on their ability to produce revenue.

Constitutional Amendment 2:

  • CA-2 received bipartisan, unanimous support in the legislature as HB 360.

  • CA-2 would result in more accurate assessments of oil and gas wells, while also allowing better predictability of tax revenue.

  • CA-2 is supported by assessors and the oil and natural gas industry.

  • CA-2 would make the income approach available to the Louisiana Tax Commission. It does not mandate its use.

  • CA-2 would only affect the valuation of oil and gas wells, and will not change the assessment of other types of property.

  • An amendment is necessary because of the restrictive language in the state constitution prohibiting the use of all three valuation methods for the assessment of oil and gas wells.

“Amendment No. 2 is the result of a joint effort of the Assessors and the oil and gas industry,  and it is supported by both,” said Belinda Hazel, Plaquemines Parish Assessor and Louisiana Assessors Association Chair of the Oil and Gas Committee. “The passage of Amendment No. 2 is necessary to achieve our unified goal, which is the fair and accurate assessment of oil and gas wells.”

“This income approach is the same method used when wells are valued for sale on the open market,” said Daron Fredrickson, LOGA Tax Committee Chairman. “It’s common sense that this valuation method should be available for property assessment purposes as well.”

“The oil and natural gas industry is the backbone of Louisiana’s economy providing jobs and economic benefits throughout our state,” said Tyler Gray, Chair of the Louisiana Taxpayer Protection PAC.  “Fair and competitive tax policies at the state level are critical to the economic health of our state.”

“This amendment brings a fairness to the assessment process for the oil and gas industry, 90% of which consists of small businesses,” said Mike Moncla, Interim President for the Louisiana Oil & Gas Association. “When independent operators can reliably predict their costs, they can allocate more to supporting and expanding their workforce. Fairness and predicability lead to more investment.”

“When this amendment was a bill, HB 360 breezed through the House committee, it breezed through the House floor, it breezed through the Senate committee, and it breezed through the Senate floor," Representative Mike Huval said. "It was just a matter of educating all my colleagues in the legislature that all parties affected, both in industry and at the assessors association, agreed that this was a fairer way going forward to assess the value of a producing oil and gas well."

About the Louisiana Oil & Gas Association

The Louisiana Oil & Gas Association was organized in 1992 to represent the Independent and service sectors of the oil and gas industry in Louisiana; this representation includes exploration, production and oilfield services. LOGA’s primary goal is to provide our industry with a working environment that will enhance the industry.

About the Louisiana Assessors Association

The Louisiana Assessors' Association is composed of sixty-four assessors, one from each parish.  The office of assessor is an elected position as provided by the constitution of Louisiana.  Each parish assessor is elected at the gubernatorial election for a four-year term of office.

Each assessor is mandated by Article VII, Section 18 of the Constitution of Louisiana to determine the fair market value of all property subject to taxation within his respective parish or district except those public service properties which are valued by the Louisiana Tax Commission.  The correctness of assessments by the assessor is subject to review by each parish governing authority, then by the Louisiana Tax Commission, and finally by the respective courts.

About the Louisiana Taxpayer Protection PAC

The Louisiana Taxpayer Protection PAC supports fair, common sense tax policies that keep Louisiana’s economy competitive and protects thousands of good paying jobs.

LANDRY: Investigation Into Suspension of Jefferson Parish Student

IMG_0251.jpeg

AG Jeff Landry announced the following today regarding a potential constitutional violation involving the suspension of a Jefferson Parish student:

BREAKING: TODAY I ANNOUNCED MY OFFICIAL OFFICE WILL BEGIN AN INVESTIGATION INTO POSSIBLE CONSTITUTIONAL VIOLATIONS IN RELATION TO THE SUSPENSION OF A LOUISIANA STUDENT JUST BECAUSE HE OWNS A BB GUN, SEEN IN HIS HOME WHILE HE WAS IN A VIRTUAL CLASS.

Jefferson Parish student Ka Mauri Harrison and his parents are seen here in a WDSU TV interview.

As I said in my official press release today, I am alarmed by what appears to not only be multiple violations of both the State and Federal Constitutions, but also blatant government overreach by the school system. I have begun investigating this matter and plan to take action in defense of this young man and his family and all families who could suffer the same invasion of their homes and constitutional rights.

For anyone to conclude that a student’s home is now school property because of connectivity through video conferencing is absurd. It is ludicrous for this All-American kid to be punished for taking responsible actions just as it is for his parents to be accused of neglect.

The School and the School Board have deprived Ka Mauri of six days of educational instruction, and that is just the start of the damage done to him and his family. My office and I will take a deep dive into all the irreparable harm caused by this egregious incident and take appropriate actions

PLEASE STAY TUNED FOR MORE.
